Overview

Presently, Obtaining a No Objection Certificate (NOC) from the State Pollution Control Board (SPCB) is a mandatory process for most industries and commercial establishments in India.

As per Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981 firstly an industry before establish any unit on the business premisses land have to process for Establishment certificate called as Consent to Establishment (CTE) certificate. And after setting up the machinery on the same business premisses area have to process for Operational certificate called as Consent to Operate (CTO) certificate. 

This process is generally divided into two main stages based on the lifecycle of the project-

1. Consent to Establish (CTE) / NOC

This is the initial permission required before starting any construction or establishing an industrial unit

Determine Business Category: Your industry will be classified by the Central Pollution Control Board (CPCB) into Red, Orange, Green, or White categories based on its pollution potential. On the basis of Catogery and on the basis of Plant & Machinery Cost there would be the finalization of the government fees. 

2. Consent to Operate (CTO)

This is the second and final permission required before commencing commercial production/operation.

Application: Once the establishment is complete, and all pollution control devices are installed, apply for the Consent to Operate (CTO), usually one month before the start of operations. At the time of process of appliaction there would be the government fees have to process. If inspection conducted by the concern authority then there would be requirement of run the machine on trail basis.
