OVERVIEW
The Uttar Pradesh Pollution Control Board (UPPCB) regulates industrial activities in compliance with environmental standards and pollution control regulations. Businesses planning to establish or operate industrial units in Uttar Pradesh may require Consent to Establish (CTE) and Consent to Operate (CTO) under applicable environmental laws. CTE is obtained before setting up a facility, while CTO is required before commencing operations. Depending on the nature of their operations, businesses may also require additional approvals to manage hazardous waste, e-waste, or other regulated materials. The approval process typically involves submitting the necessary documentation, paying applicable fees, and fulfilling prescribed pollution control conditions.

What Are UPPCB CTE and CTO Consents?
Before the establishment of any industrial unit in Uttar Pradesh, business owners need UPPCB Consent to Establish (CTE) under the Air and Water Act. Consent to Operate (CTO) is also required for recyclers before starting production or operations. The list of documents required to get the CTO and CTE approvals depends on the type of industry, pollution load, water use, wastewater generation, air emissions, STP/ETP requirement, hazardous waste, etc.
Regulations governing the approval process include Hazardous Wastes (Management & Handling Rules), 1989 (amended in 2000), The Water (Prevention and Control of Pollution) Act, Air (Prevention and Control of Pollution Act), 1981, etc.
The import of hazardous wastes is banned for dumping and disposal. However, with proper authorisation issued by the MoEFCC, traders and recyclers can deal in scrap waste as per the proposed trans-boundary guidelines for hazardous waste.
Approvals and Licenses issued by UPPCB for recyclers and traders:
For manufacturers, recyclers, and industrial units:
Consent to Operate (CTO)
For new units/expansion projects:
Consent to Establish (CTE), as it is a foundational permission issued by the UPPCB before any construction or installation of machinery begins.
For traders:
One-Time Authorisation (OTA), valid for 5 years, issued for traders involved in the import-export business of scrap metal and other hazardous materials.
No Objection Certificates (NOCs):
Consents assessing and collecting water cess, identifying and controlling industrial and municipal pollution sources, monitoring air and water quality, and instituting legal actions against defaulters.
Industry Categorization for UPPCB License
Red, Orange, Green, and Blue Categories
As per UPPCB, industries are classified into various categories based on their Pollution Index (PI), which has a score from 0 to 100. UPPCB aligns with the recommended guidelines of the Central Pollution Control Board (CPCB). The PI classifies industries based on their pollution potential, considering air, water, and waste pollutants. Categories are classified as per the risk-based regulatory model.
- Industries with higher pollutant loads (Red and Orange categories) undergo comprehensive review, regular audits after licensing, and shorter validity periods.
- Industries with lower pollutant loads (Green and White Categories) have reduced license scrutiny and longer validity periods.
Based on the category allotted, industries adopt cleaner technologies to reduce their Pollution Index and promote sustainability. Industries shift from one category to another based on their PI performance. Shifting to a lower PI category gives extended CTO validity periods, while shifting to a higher category means stricter inspections and regulations for the industry. There is a Blue category for low-pollutant industries. Blue-graded industries benefit from longer validity periods (up to 20 years).
