The E-Waste Management Rules were introduced in India in 2016, to regulate the safe handling, recycling, and disposal of electronic waste, under which the Central Pollution Control Board and State Pollution Control Boards issued licenses for setting up e-waste recycling plants. Any company or person planning to start operations in India must obtain an e-waste recycling plant license to legally collect, process, and recycle electronic waste in compliance with environmental regulations.

What is EPR Ewaste 

The E-Waste Management Rules 2016 stipulated that any entity in India that Importers or manufactures of electronic goods is responsible for recycling those products once their lifespan ends. Changes in E waste Management Rules in 2024

The 2016 E-Waste Management Rules were amended in 2024 by the Central Pollution Control Board. The amendment stated that the recycling capacity of an e-waste recycler would now be determined based on plant and machinery installed, allowing for a recycling capacity of up to 20 hours per day.

Under the E-Waste Management Rules 2024, after setting up an e-waste recycling plant, the State Pollution Control Board will conduct an inspection to verify the machinery and check its capacity.  They will then issue a Consent to Operate license ( CTO) based on the plant's metric ton capacity.  For such licensing support who want to set up an E waste recycling plant , can connect with Enviroxperts.

An e-waste recycler must installed machinery , which will be checked during the inspection. The details of the adequate space that must be arrange by E-waste recycler jn the recycling plant  as outlined in the new E-waste Management Rules 2024, are as follows:

Responsibility of E waste Recycler as per E waste Management Rules 2024

According to the New E-waste Management Rules 2024, recyclers must maintain material flow records at every step of the E-waste processing. When a recycler recycles E-waste, non-recyclable,  hazardous waste materials and raw material will be generated, which must be recorded and updated on the EPR portal. A list of the types of materials that will be generated during this recycling process is mentioned below.

1. Gold in the form of nuggets

2. Copper in the form of shreds or powder or ingots/bars

3. Aluminum in the form of shreds or powder or ingots

4. Iron in the form of bales or shreds

All records maintained by the recycler will be audited by the State Pollution Control Board and the Central Pollution Control Board or an independent auditor.

Recyclers required to maintain material flow record at each stage of processing in terms of input and output weight. Recyclers should also maintain records of following products /non –recyclable / Hazardous Waste materials besides the end products, as derived from E-waste. List mentioned below for ensuring material balance as per the requirement of the EPR Portal:

1. Other metals such as Tin (Sn), Palladium (Pd), Platinum (Pt), Silver (Ag), Rare Earth metals if any 

2. Plastic 

3. Puff

4. Rubber

5. Oil

6. Refrigerant gases

7. Residues of Recycling

8. Hazardous Waste generated and its disposed to TSDF facility 

E Waste Refurbishing License 

If an e-waste recycler also wants to perform refurbishing, they must show this capacity separately at their plant. This means that the e-waste recycling unit will be located in a separate area, and the quantity of refurbished items must be declared separately at that location.
